I showed the cop the CHP bulletin allowing a certian noise limit for modified exhausts. Yeah, I heard of this.. I even showed it to the CHP officer at the fix it ticket office.

He basically said, he does not know what to do about it. I asked him that it shows that I am allowed 95 dB's at 20 inches from the tail pipe in the 3000-5000 range. I even brought my own dB meter to prove to him that I was not above that amount! He said he does not know what to do about it. What the hell does that mean, it tells you what to do about it! He said he does not know what to do about it...

He said we could not use my dB meter because its not a state bought instrument. He also said that the state will not be buying any dB meters, and it was up to the "disgression" of the officer that pulls you over.

So what it comes down to is this, they have a law that they cant properly enforce, so they will just keep writing tickets anyway and collecting money from the people with cars.

My understanding is if the officer even thinks that it MAY be to loud they can pull you over for a violation of VC 27151. And whether its fixed or not, its a 70 dollar fine. Wether you are innoscent or not, they will get 70 dollars from you. They admit they cant enforce the law, but keep writing tickets anyway. Its just unfair. My best advice is to keep a copy of the No. 98-100 CHP bulletin in your car, and if the "cop" tells you its illegal to modify your exhaust at all, you can show him/her that sheet of paper.

Its a damn same this is happening. I dont know whats worse. Either the police officers dont know the law, or they know it and are ignoring it. Either way, we as citizens are being taken advantage of!

the fine is 70 dollars now? i just got a fuckin ticket for my exhaust yesterday the dumb cop pulled me over and said my exhaust was modified i was like now shit. i told him it meets all emission and decibel requirements but he said as long as it's modified it's illegal, i asked him what about if your stock exhaust is broken and he said you have to get it from the dealer i was like bullshit do you want me to turn on my engine so you can hear the exhaust and all he kept saying was as long as it's not the stock exhaust its illegal, obviously he didn't know what the fuck he was talking about. and now i have pay 70 dollars? and you said whether i fix it or not i have to pay 70 dollars? then why should i fix it? also he gave me a speeding ticket at the same time for going 51 on a 35 street. I am positive the most i could have been going was 45 he said he was pacing me and i though bullshit you were only behind me for less then half a mile and i saw his ass behind me so why would i be speeding. No way am i paying for this shit. I am going to ask for an extension and drag it for as long as i can and then i'm fighting it in court. fucking dumb cops don't know shit (i'm not saying all cops just the friggin ignorant ass pigs)

It's pretty bullshit when you have to pay a ticket for something that you are innocent of. It just goes to show the fucked up aspects of the law/govt. I'm just glad I don't drive a rice; you guys get picked on too much for what seems to be for no reason most of the time.

All sjpopo said is the officer will have to use his "professonal judgement" to determine the exhaust.

Their judgement can be purely VISUAL .

well unfortuantly he's probably gonna say the same thing to you that he said to me. I know I know...it's fustrating...but what can you do? I wish the law was more clearly stated...try to fight it in court...if you put up a good battle then I'm sure the judge will lower the fine if not completly take it off. Good lcuk and let me know what's happens.

I don't know what to tell you on the exhaust thing. Personally, I don't deal with it at all. When I was working dayshift on the east side of San Jo, I saw many street racers in that neck of the woods, probably some who post here, and never dealt with them much. I have a Flowmaster on two of my cars and obviously don't get hassled for it given my lack of street racing. I guess the tough question you have to ask yourself is, If I go to court, and the judge came outside and I revved the engine up, what would his ruling be? If for some reason I felt the need to cite for modified exhaust, I suppose my justification would be that a judge would listen and concur that the ticket was justified. As far as an officer saying that if it isn't the stock exhaust, it's illegal, I believe that is quite incorrect. Muffler businesses would be closing their doors daily.

Some of the car dealerships sell their cars with aftermarket exhaust already on them. I know Saturn on Stevens Creek used to do some package with rims and a dynomax exhaust or something. So that means it came from the dealership that way. And of course, on the other hand...I'd ask an officer who told me I had to go the dealership how Midas stays in business. This whole thing is getting out of hand...then again, as long as I stay out of the 408, I don't have to deal with it.
