View Full Version : Question about "Unsafe Speed" for SJPoPo

How does a Police officer decide that your vehicle is traveling at an unsafe speed? Let's say he was outside his car and saw me drive by. He didn't get the me on the speed gun but he said I was doing 60 on a 35 but I highly doubt that. I don't know if this make a difference but the officer said I was coming down from a hill but in fact I was coming about of a street. Can I fight this? Thanks for your time.

so, say he was off by up tp fifteen miles an hour and you were doing 45 in a 35. Most cops will stop you for that, I hope.

But it was a 35, so you may not have been doing sixty, but it was obvious that you were going over the speed limit.

This may be hard, because everyone thinks they were right, but I would just pay it. Its not like a bogus exhuast (or as we are finding out a bogus nitrous ticket), you really have nothing to stand on. BTW, slow down, if you missed the cop you could have also missed something that would have gotten you into an accident

Other than the "bogus nitrous" comment, I loved the answer. Off the original topic, but nitrous has no place on street cars. Still investigating. Awaiting a call back from the SJFD Hazmat people.

man fight that friggin ticket, i just got a stupid speeding ticket and bogus exhaust ticket yesterday, the stupid cop said i was going 51 on a 35 and i was certain i was nowhere near 51. he said he was pacing me but it was for less then half a mile and i saw his stupid ass behind me so i made sure i wasn't speeding. anyone know if you have to pace a person for a certain distance before they can determine your speed? also for the exhaust the cop said as long as it is modified it is illegal, what the hell? i said it meets emissions and is way lower then 95 db and he said it doesn't matter! what the fuck doesn't matter?!? then what does matter? I asked if he wanted me to turn on my engine and rev the sucker up and he said no? anyway i can fight this? i heard the fine is like 70 dollars now? i'm not friggin paying 200 plus dollars for nothing!

hey, the citation i got was 22350 unsafe speed and 27151 modified exhaust. for the speeding ticket can i aruge that i was indeed going at a safe speed? and for exhaust ticket is there really a cvc that says an exhaust can't modified. I thought it was only illegal if it was too loud. as for emissions part, a muffler doesn't really do anything for emissions it just lowers the exhaust noise so.... any help would be much appreciated. you can post a response here or you can email me at dreamspeed_1@mail.streetracing.org. thanks

I thought traffic cops had to pass a speed guessing test now like judging speed from a 1/2 mile away within 5 MPH? Most of the time theyre pretty accurate, and it will probably come up in court that he has passed that test, then youre screwed. Plead guilty or no contest and maybe you wont get punished so harshly

I wasn't there when you got the cite, so I have no way of really knowing what went on. So, I can't give you any insight into how the officer gauged your speed. Also, it would be unprofessional for me to suggest what you should do in court.

Look up 27151 in the CVC (see link below) and read it carefully. If the noise from your exhaust has risen due to your new muffler/exhaust system, then it might be loud enough to be cited under 27151.
