selling a car/ smog reg stuff

i know the smog is sellers resonabilty..

But i was told if i sold the car AS IS
it would not be my responsibity to smog it as the seller

If the emmissions control equipment test IS the Seller's responsibility how can you sell the vehicle, "As Is?" Be responsible and get it done. It's your fault if you're still the owner and it's not in compliance with the law.

yes you can sell a vehicle as is, no smog. just make sure you right it out just like that on the bill of sale.

this vehicle was sold to xxxxx as is no smog, buyer responsible for smog, for xxxxx etc. etc. etc.

From the DMV Website:

"If you are selling a vehicle that is less than 30 model-years old, California law requires you to provide the buyer with proof that the vehicle has passed a Smog Check inspection within the preceding 90 days. To comply with the requirement, you should give the buyer a passing Vehicle Inspection Report (VIR) that was give to you by the Smog Check station when you had the vehicle inspected."

And also:

"When a car is sold, who is responsible for the inspection?

The seller is required to provide the buyer with a valid smog inspection certification at the time of the sale or transfer. Smog certifications are good for 90 days from the date of issuance.

The inspection is not required on a transfer if a biennial smog certification was submitted to DMV within 90 days prior to the vehicle transfer date (a vehicle inspection report may be required for proof of certification)."

To add with what SgtGrant says.. just incase some of you guys just don't get it.

When a car is sold "AS IS" the SELLER is still responsible for smog. After it is pases, everything else is "AS IS".

You can put it on paper, have both buyer and seller sign saying the car is sold "AS IS" but still Seller is still responsible for smog. So.. don't think you can ever get away with having your car sold "AS IS", cause it can bite you in the ass.
