hey i just wanted some feedback on the ticket info in milpitas and fremont...for spectating races, what are the tickets given as? loitering? support of illegal street racing? and what if you are 17 do u get a curfew violation on top of that? last, do these retarded tickets have anything to do with the increase of car insurance?

i think only moving traffic violations get your insurance company pissed off. so you could rob a bank and you'll still have the same insurance premium... (i think)

Generally, only moving violations count as points on your driving record. However, all violations go onto your DMV record. Many employers require a printout of your DMV record as a condition of employment. If you are 18 and your DMV printout is 3 pages long, that may be a red flag to an employer.

23109(b)is a midemeanor and probably a pricey ticket. It gives you a criminal record, but I don't know if it counts as points.

Curfew is a city-by-city ordinance. In San Jose, if you are 17 and you are out after 1130pm, you can be hauled off to the curfew center where you'll be held until your parents can come pick you up.

i think if they catch the flagger or witness you being
a look out they can charge you with aiding and abbeding (?)

carefull where you race at, i almost got trespassing cuz
the area was private propery with no trespassing signs
which is also misdemeanor, tow, and night in jail. most
the industrial parks are private property but it's also
coo because if you get caught doing burnouts or donuts
if you get the owner to sign a letter you get out of it
because the laws are different on private property.
im not 100% sure tho sjpopo is this correct?

There are four sections to 23109VC, here's a short definition of each:

(A) Involved in a speed contest (racing)
(B) Aiding and abeting a speed contest (spectating)
(C) Exhibition of speed
(D) Barricading/obstructing the roadway for the purposed of a race

Now, as far as DMV is concerned, sections A and C are two point violations. Sections B and D are one point violations.

I'm sure you could argue this, say for example you walked to the runs from your house, never set foot in a car, and stood there watching. Then the cops come and stop you and cite for 23109(b). Well, obviously it has nothing to do with your driving, and is not a moving violation, so it shouldn't be a point when it comes to DMV. But that is up to the courts to decide, and all of the standard fines, etc still apply.

All other single point violations are directly related to a moving or at least being inside of a parked vehicle, and this is about the only one you could possibly get points for when you were never in a vehicle.
