yesterday morning i was going through the sierra (california side) and i was doing 58 in a 55! I was currently in a road rally and had stickers all over my car promoting it. anyways, what is the best way to deal with it. i dont want to go to court because i would have to go all the way back to the sierras. i would like to driving school it, would this be the best was not to have the insurance agency not to find out?

You say you were doing 58 in a 55, but what did the ticket say? I find it hard to believe that the CHP wrote you for 3 mph over. Most CHP know that there is easily a 3 mph variance in most folks speedometers and generally won't bother with anything at least 5-10 mph over. Was there any other violations on the ticket too?

I also find it hard to believe that an officer would ticket you for 3mph over. What mph did the ticket say and what code section is the violation. You are correct to be concerned with the effect this will have on your insurance. One ticket is not too bad but it stays on your record for three years and who knows what will happen. Many employers are now reviewing driving records as part of the hiring process.
You should never just pay for a ticket.

Normally I would recommend traffic school but 58 in a 55!
Since you are out of state you may want to consider the following.
I am not an attorney and this is not legal advice, just information.
40519. (b) Any person who has received a written notice
to appear may, prior to the time at which the person is
required to appear, plead not guilty in writing in lieu
of appearing in person. The written plea shall be directed
to the court named in the notice to appear and, if mailed,
shall be sent by certified or registered mail postmarked
not later than five days prior to the day upon which
appearance is required. The written plea and request
to the court or city agency shall be accompanied by a
deposit consisting of the amount of bail established
pursuant to Section 1269b of the Penal Code, together
with any assessment required by Section 42006 of this
code or Section 1464 of the Penal Code, for that offense,
which amount shall be used for the purpose of guaranteeing
the appearance of the defendant at the time and place set
by the court for trial.
Include the following:
Your name
Address
Phone Number
The Ticket Number (found at the top of the ticket)
A statement: "I wish to plead not guilty per CVC 40519
and request trial by declaration per CVC 40902."
Your signature
Do not forget you must include a certified check
or money order for the bail.
Call the clerk of court for the amount.
---------------------------------------
You will receive notice from the court of your due date
for the declaration. The most important thing about
submitting a declaration is that you do it by the due
date. You should send the declaration via Certified Mail
Return Receipt.
Your Name
Address
Phone Number
The Ticket Number
Your declaration.
"I stand by my plea of not guilty."
If the officer fails to submit her paperwork,
the judge will have to dismiss your case and
refund your bail.
If you are dissatisfied with the decision,
you are by law entitled to a new trial.
You will need to request it. Usually the judge will
still allow you to still take traffic school. This can be
done online at
