you have the right to your constitutional rights. whether its written or not in any state law book, you can protect your rights. if you get pulled over they can not search you or your car without a warrant unless you are being arrested for something. they can say that they have probable cause but you also have the right to know what that cause is and why they need to search your vehicle for that cause. here in texas, you can protect all your rights. i've nothing to hide in my car but still won't let them search it, just as your house, would you let them search your house for no reason??? ha yeah right...

well if the cops say they'll tow your car they better have a good reason to. if they make you let them search your car that is violating i think your 4th or 5th ammendment rights and therefor that alone will be enough to go to a trial by jury under a supreme court due to the fact that your civil rights were violated by a peace officer. i know from personal experience and guess what the cops that pulled me over were suspended. they cuffed me and everything and put me in the back of a police car searched my car all because i was doing 9 over the speedlimit on my way to school, which was less than 400yards away (college so there was no school zone) and the reason they searched my car was because they said they saw a "cellophane" wrapper from my cigarette box and thought i had drugs in it. but they never asked me if they could search my car, and guess what... the car was clean. the second time this happened to me was when i was leaving a friends house and some high school kids were setting up a fight at someones house in his neighborhood and they blocked off the neighborhood and they pulled me over and askedm e to get out of the car, when i refused to get out of the car they said theyd have to search my car "for drugs and weapons" before i could leave. i told them no and the cop opened my door and grabbed me through me on the ground and then another searched my car... i told him i was on my way home from my friends house and i didnt know what was going on. he apologized and then i got both their badge numbers from the detective that was there and wrote them up on charges... luckily it was on video tape and guess what.... the one who through me out of the car on the ground was fired. the other was suspended. pretty cool shit huh.... so in essence, WE CAN WIN.

Even w/ probable cause they are only allowed to search the immediate area of the driver. They have to have the permission from the vehicle owner to search the trunk. If the car is not in your name and they ask to search the trunk you are legally entitled to say NO. At that point they may either contact the vehicle owner or risk potential legal backlash. Later!
